PRACTICAL COMPLETION
We were assigned to write a report for this assignment. It constitutes 30% of the total assessment. We were divided in a group of 5 and were needed to give a sound professional advice to a client who has embarked on a project and had some problems at the post contract stage.
A contractor has appointed us as their Claims Consultants to provide contractual advice on the below matters:
(1) Explain the definition of 'Practical Completion' in legal cases and any timeframe provided in the standard forms of contract for the Superintending Officer to hold back the issuance of a Certificate of Practical Completion (CPC).
(2) Does the Superintending Officer has to issue a partial practical completion certificate to the Contractor if there is still a minimal portion of outstanding work due to the fact that the Contractor was prevented from completing the project due to a site possession problem? What other options does the Employer have in this situation?
Hence, we are required to submit a contractual review report support with case law and have a separate analysis section where we will compare the advice given based on the PAM Contract 2006, JKR Form 203 and FIDIC Red Book Conditions of Contract.
My group mates were Darren, Lucas, Bear, Jia En and I. After several discussion, we divided the questions given into 5 parts and each of us answer one question. As for me, I was responsible for explaining the definition of 'Practical Completion' in legal cases and its definition as contemplated in PAM Contract 2006, JKR Form 203 and FIDIC Red Book Conditions of Contract with relevant clause found.
Through this assignment, it really gave me some knowledge on practical completion. My group mates and I really done a good job in this assignment. We were glad that we were able to meet the deadline of this assignment. We were well prepared for this assignment after all.
